TERMS AND CONDITIONS
1 Operator and agreement
These Terms apply to the remote baseball and softball coaching program, Clubhouse and related services provided by Richard Andrew Kachel, operating in Arizona under the business name Tilt House Hitting (“THH,” “we,” “us”). Contact: [email protected]. THH operates remotely and is not represented as a separate LLC or a physical training facility.
The enrolling adult must review and affirmatively accept these Terms before completing enrollment. If enrolling an athlete under 18, you represent that you are their parent or legal guardian and have authority to enroll them and provide the required permissions. A person paying for another adult’s membership does not automatically have authority to grant that athlete’s privacy or publicity permissions.
The selected offer, these Terms and any specifically agreed written amendment define the purchase. If an order confirmation contains an error or conflict, contact us so it can be corrected. We will not use general boilerplate to remove a specific benefit clearly promised at purchase. Mandatory consumer rights take precedence over conflicting language.
Our Privacy Policy explains information handling: https://tilthousehitting.com/privacy-policy . Section 10 describes the permission sought for organic Instagram posts. A privacy notice does not replace separate consent where the law requires it.
2 Eligibility and account access
THH accepts baseball and softball athletes of all ages and playing levels, including international members. A parent or legal guardian must enroll and authorize a minor. Parents should manage younger athletes’ accounts; parent-authorized athletes may upload footage, chat, send direct messages and attend calls only as permitted by applicable law and platform age restrictions. Required notices and consent must be completed before the relevant collection or disclosure. A parent’s email, ordinary sales conversation or general checkout acceptance is not automatically sufficient. THH does not represent this as a parent-only service.
Provide accurate athlete and payer information. After successful payment, register for the THH community through GoKollab using the enrollment email so THH can match and approve access. A free-to-create platform account does not itself include paid THH coaching. Protect credentials and report unauthorized access. Membership is for the athlete and authorized guardian, not unrelated athletes.
3 What the remote membership includes
The remote membership is purchased for either a 6-month or 12-month term, as selected at checkout. During an active term it includes 3 swing reviews per week, a personalized monthly program and weekly group calls, together with the program resources identified in the offer.
Video analysis takes place Monday, Wednesday and Friday using Arizona time (America/Phoenix). Submit ahead of the review day when possible. The final cutoff is 2 p.m. Arizona time on each review day. Later submissions move to the next scheduled review day: Sunday footage is reviewed Monday, and Tuesday footage Wednesday. The usual review window is noon to 2 p.m.; footage accepted near the cutoff may be reviewed later that day. There is no separate 24-hour-from-upload promise.
Multiple clips may be included in a submission, without a fixed clip-count limit or a requirement to edit them into one video. Game at-bats and training footage are welcome; rear and side views, including a view from the opposite batter’s box, are useful. The three scheduled review opportunities are not credits banked when a day is skipped. Baseline and reassessment arrangements are confirmed in onboarding; no separate extra review entitlement is implied.
Use Assessment for the initial baseline and Film Room for later swing submissions. Members may send direct messages with quick questions anytime; this does not mean continuous coach availability or instant replies. Full breakdowns follow the scheduled review days. Weekly group calls are included. The entire meeting is recorded and posted inside the member community; it may contain participant images, voices, names, chat and shared footage. THH must notify participants of recording and obtain required consent. A session may end if no member attends.
One-on-one Zoom lessons are purchased separately, normally available Tuesday and Thursday subject to booking availability. Active community members receive 40% off the applicable standard lesson price. Unlimited private live lessons are not included. THH generally creates a lesson transcript rather than a full video recording; appropriate notice and any legally required consent must precede transcription. The Privacy Policy describes information handling. Private-lesson transcripts are not included in the organic Instagram permission.
We may adjust lesson content and scheduling to support the program. We will communicate material schedule changes and provide a reasonable replacement for a group call we cancel. We will not materially reduce the core purchased services during a paid term without an appropriate remedy and any consent required by law.
4 Term dates and payment
The paid membership term begins when enrollment payment succeeds, including an agreed first installment where a payment plan is offered. Access is approved against the payment and enrollment email. Early-access members start when they pay; public launch does not postpone their term. A member’s delay completing onboarding does not extend the term. THH-caused access problems are addressed without treating them as the member’s delay. The confirmation identifies the purchased term and start/end dates.
Checkout states the total membership price, currency, applicable taxes and payment arrangement before purchase. Card, PayPal and Cash App may be available as displayed. Installments or third-party financing are available only when actually offered and accepted. These Terms do not promise an arbitrary 15- or 30-month plan. The accepted agreement must disclose payment amounts, dates, number of payments and any provider interest or fees.
A payment schedule does not extend the coaching term unless expressly agreed. Stopping a future renewal does not by itself erase valid installments owed for an already purchased term, subject to applicable rights and refunds. If a payment schedule extends beyond the coaching term, its interaction with renewal must be expressly explained before acceptance. This paragraph does not authorize undisclosed overlapping charges.
You must have authority to use the payment method. An initial failed payment does not establish paid enrollment. For later failures, THH contacts the member to resolve payment and confirm any effect on access or coaching. One failed payment does not automatically remove the locked-in rate. Any retry, fee or suspension must follow the accepted payment terms and applicable law; no undisclosed penalty or specific grace period is created here.
5 Renewal and stopping future charges
Memberships automatically renew for the same selected six- or twelve-month term unless renewal is cancelled before the next charge, provided required disclosures and valid express consent were obtained. The agreed rate stays locked while membership continues, including for non-founders. Checkout and confirmation state the recurring amount, interval and next charge date. An approved pause or agreed plan change adjusts the schedule as explained below. General updates to these Terms do not override locked-in pricing.
To stop renewal, email [email protected] or directly message Coach Andrew requesting cancellation. If your account provides a subscription-cancellation control, you may also use it. THH acknowledges cancellation and confirms the end of paid access. A timely request takes effect when received; THH’s processing delay does not authorize another charge. No call or explanation is required. Removing the app, leaving a channel or not logging in does not itself notify THH to stop billing.
We provide renewal, price-change and other notices, and obtain additional consent, when required by applicable law. A general right to update these Terms does not authorize a new recurring charge or bypass required notice. Turning off renewal does not ordinarily end access before the already-paid term expires and is separate from a refund request.
6 Founding member rate
The introductory founder offer is available only to the first 20 confirmed founding athletes: US $599 for a six-month term or US $999 for a twelve-month term. These are founder-only total membership prices, not monthly charges or the permanent price available to every new member. Once the 20 founder places are filled, new enrollments are offered at THH’s then-current price, disclosed and accepted before payment. Future new-enrollment prices may increase; no tentative future price becomes binding through these Terms. A separately negotiated individual price must be recorded in writing and does not create an additional founder place. Any installment schedule separately states how the accepted total is paid.
Your agreed rate stays locked while you continue with THH. Verified founders retain their agreed founder rate under this continuing-membership promise; closing the introductory offer or raising prices for new enrollments does not change their rate. A later non-founder’s locked rate is the price agreed for their own enrollment, not the founder price. Approved injury pauses and payment issues being resolved with THH do not automatically remove the agreed rate. Turning off renewal alone does not end paid access or change the rate during the paid term. If you leave and later rejoin, any continuing-rate exception must be agreed with THH; no new guarantee for lapsed membership is created here.
A founder may change from six months to the annual founder plan at the next renewal. The new annual term starts at the end of the current paid term, at the annual founder rate. THH confirms the changed amount and dates before charging. There is no automatic immediate conversion or retroactive credit. Other changes require agreement before billing.
7 Refunds and pauses
Except as required by law or expressly stated in your accepted offer, payments are nonrefundable for change of mind, failure to use available services or dissatisfaction that does not involve a failure to provide the promised service. Results are not guaranteed, as explained below.
This policy does not limit remedies for unauthorized or duplicate charges, services we fail to provide, misrepresentation, or any other situation where applicable law requires a refund or other relief. Contact [email protected] about an error or service issue. You retain your lawful rights to dispute a charge or seek an external remedy; contacting THH first is encouraged, not a waiver or mandatory barrier.
If THH permanently ends the program or cannot provide a material portion of the remaining purchased services, we will offer an appropriate remedy, including a refund for the undelivered portion where required or agreed. A general no-refund statement does not allow us to retain payment for services we elect not to deliver.
Contact THH to arrange an injury pause. An approved pause stops the membership clock and moves the term end and renewal date back by the same duration. Community access and existing resources remain available, but swing breakdowns, video analysis and live lessons are paused. THH and the member confirm when the athlete is ready to resume. The locked-in rate is preserved. THH records revised dates; an injury pause does not automatically modify a separate lender’s payment agreement.
8 Training safety and limits of remote instruction
Baseball and softball training involve risks, including being struck by a ball or bat, falls, collisions, overuse and other injuries. Remote coaching cannot inspect or supervise every session, location or piece of equipment. You acknowledge these inherent risks and agree to take reasonable safety precautions.
Use a suitable training space, appropriate equipment and protective measures, follow facility rules, keep bystanders clear and obtain appropriate adult supervision for minors. Do not attempt a drill when the conditions, equipment or your physical condition make it unsafe. Stop if you experience pain, dizziness or other concerning symptoms and seek appropriate medical attention.
THH provides sports instruction, not medical diagnosis, rehabilitation or emergency services. Consult a qualified healthcare professional when an injury or health condition raises a question about participation. Tell the coach about relevant training limitations without posting private medical records in the community.
This acknowledgment does not release liability that applicable law does not permit to be released, does not excuse reckless or intentional misconduct, and does not purport to waive a minor’s nonwaivable claims. Any separate activity release must be specifically reviewed for the applicable jurisdiction and enrollment process.
9 No promised athletic outcome
Coaching, feedback and training resources do not guarantee a particular performance increase, exit velocity, roster position, scholarship, recruitment outcome or professional opportunity. Results depend on factors such as experience, practice, physical condition and circumstances outside THH’s control. This does not reduce our obligation to provide the services you purchased or excuse false statements about the program.
Testimonials describe individual experiences. They are not a promise that you will obtain the same outcome.
10 Athlete content and permissions
You retain ownership rights you have in your original submissions; uploading does not transfer ownership to THH. You authorize THH and its providers to host, copy, format, review and display material as needed for coaching, feedback and disclosed community features, subject to the Privacy Policy and applicable law.
Assessment, Film Room and Wins posts and feedback are visible to THH, its authorized team and community members. They are not coach-only private submissions. Do not upload another person’s footage or private information without authority. Members may not redistribute other athletes’ content without permission.
Organic Instagram permission — Wins and Film Room only. To the extent you have authority and applicable law permits this form of agreement, acceptance authorizes THH, non-exclusively and without royalties, to repost or excerpt Wins and Film Room submissions on Coach Andrew’s Instagram account associated with THH to show wins, swings, progress and testimonials. Initial Assessment submissions, paid ads and unrelated uses are excluded. THH may crop, caption or format material without misrepresenting the athlete’s experience. Last names and identifying text will be removed or obscured; the athlete may remain recognizable through image, voice or swing.
For a minor, authorization must come from a legally authorized parent or guardian. Email [email protected] to stop future promotional use; THH records and honors that preference without removing purchased coaching benefits. Where separate consent or a separate disclosure choice is legally required, THH must obtain it before posting; these Terms alone do not replace it. Permission does not automatically cover other people in a clip, group-call replays or private-lesson transcripts.
Membership ending does not automatically remove existing community or Instagram posts. THH does not promise automatic removal of every previously authorized Instagram post merely because a member changes their preference. Contact [email protected] about removal, objection or withdrawal; THH must honor applicable deletion, consent-withdrawal and other legal rights, including removal where required. These Terms do not grant irrevocable rights to every submission forever. Account deletion is not guaranteed to erase all content or copies. Paid-ad testimonials require new, specific authorization.
11 Community standards and program materials
Treat athletes, families and coaches respectfully. Harassment, threats, discriminatory abuse, unlawful conduct, unauthorized account sharing and misuse of another person’s content are prohibited. Do not post sensitive personal information in shared channels.
THH may remove offending content or restrict access when reasonably necessary to protect members, security or lawful operations. Where appropriate, we provide notice and an opportunity to correct a problem; urgent safety issues may require immediate action. If membership is terminated, we explain the effect on access and any refund determination consistent with these Terms and applicable law. We do not impose automatic forfeiture of every remedy for any alleged violation.
THH’s curriculum and original training materials remain THH’s or its licensors’ property. Members may download their own coaching feedback where the platform allows and keep those copies for personal use after membership ends. Community access ends with membership. Downloading does not authorize resale, redistribution or publication of THH’s instructional library or another athlete’s content, and does not transfer ownership of an athlete’s original submission.
12 Service availability and responsibility
Online services may be interrupted by maintenance, internet issues or third-party outages. We take reasonable steps to restore access and communicate material disruptions. An outage does not automatically excuse a failure to deliver core purchased services; we address substantial service loss with an appropriate remedy under Section 7 and applicable law.
Each party remains responsible for its conduct as required by law. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including protections for fraud, intentional misconduct, gross negligence or personal injury where applicable. These Terms do not impose a general monetary cap on liability or waive statutory rights.
13 Changes and resolving concerns
We may update these Terms prospectively and will provide notice of material changes as required. We do not retroactively remove accrued rights, reduce core benefits already purchased or change agreed founder pricing through a general update. Changes requiring affirmative consent take effect only after valid consent. The applicable version and accepted amendments should be retained with the enrollment record.
Please contact [email protected] with a concern so we can try to resolve it. This invitation does not prevent you from contacting a regulator, using available small-claims procedures or exercising other legal rights.
These Terms are governed by the laws of Arizona, subject to any mandatory protections of the consumer’s applicable jurisdiction. This clause does not remove nonwaivable local protections. No mandatory arbitration, class-action waiver or exclusive distant-court requirement is included. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
